Where can we ship?

The "Preventing Online Sales of E-Cigarettes to Children Act" was buried in the massive Omnibus spending bill and signed into law on December 27, 2020. Among other things, this law mandates:

  • Sellers must collect all state and tribal excise taxes
  • Purchasers must present a 21+ adult ID to delivery drivers
  • The postal service must create a rule prohibiting shipments of vapor products
  • While not required by law, UPS, FedEx, and DHL have also announced prohibition of shipments

When does it take effect?

We already cannot ship via FedEx and UPS.

DHL stops accepting shipments on March 26, 2021.

As a government agency the USPS must go through a formal rulemaking process. They published their proposed rule on 02/19/2021 and were accepting public comments until 03/22/2021. While they signaled that the final rule may take effect immediately upon publication with no grace period, there is no telling when it will get published. We are operating in "sudden death" now.

The adult id and excise tax components go into effect starting March 27, 2021.

What are our plans?

We have been working dilligently to put together our own distribution network of smaller regional couriers. Unfortunately far more are saying "no" than are saying "yes". Our prospective map at this time covers 50% of customers, but we will continue working to cover at least 75% of customers in the future. Some rural addresses or locations outside the contiguous United States may be difficult or impossible to serve.

Shipping times will be slower. Shipping prices will be higher. Things will likely be rough at first while we work out the issues. Our integrated tracking tool is not yet ready as we have been focused on critical "day one" problems.

State & Local Laws

Aside from the federal law there are some state and municipal bans that we must enforce.

We cannot ship any products to Maine, Vermont, New York, Arkansas, South Dakota, Utah, Chicago, or San Francisco.

We cannot ship flavors besides tobacco to Massachusetts, Rhode Island, or New Jersey.

We cannot ship flavored pods or disposables besides tobacco to Maryland.
